Directive 95/46/EC on data protection (Data Protection Directive) was formally implemented in November 1999 through the Data Protection Act 1999 (Ley Orgánica 15/1999 de Protección de Datos de Carácter Personal) (LOPD). However, Spain has had data protection legislation since 1992 (LORTAD), which was aligned with most of the Data Protection Directive.
Data protection laws are enforced by the Spanish Data Protection Agency (Agencia Española de Protección de Datos) (AEPD). The Practice is registered in the Agency and complies with the regulations.
Every patient will be asked to sign a form in which they will agree the collection and processing of their personal data, under the actual regulations, just to be used for clinical purposes.
Dr. Rafael González de Gor Santos is the data controller, and the file is stored at the Practice. You may exercise the rights of access, modification, cancellation and objection to the data, by writing to Pl. Ginebra, 11 - Manilva 29692 Málaga.
The Practice works on paperless regulations, so any reports or letters will be stored in a digital form, and originals given back to patients, who will be responsible for looking after them.
